The President of the Kyrgyz Republic, Sadyr Japarov, has signed a new law regarding mediation, which was adopted by the Jogorku Kenesh on September 25, 2025. This information has been posted on the official website of the head of state.
The main goal of this law is to strengthen public trust in peaceful conflict resolution and improve social stability. It also aims to integrate mediation into the legal system as an alternative dispute resolution mechanism in certain categories of civil and criminal cases, including the provision of state legal assistance in this area.
According to the new legislation, the following changes are provided:
1) Amendments have been made to the Civil Procedure Code, requiring parties to attend a mediative informational meeting;
2) A provision has been added to the Non-Tax Revenue Code stating that in the case of resolving a dispute through mediation, half of the state duty will be refunded;
3) Changes to the Criminal Executive Code require the administration of correctional institutions to submit requests to the court regarding applications for parole from convicted individuals, along with attached mediation agreements, within ten working days;
4) Amendments to the Criminal Procedure Code state that:
– a criminal case cannot be initiated, and an already initiated case must be terminated if the victim withdraws the accusation or reaches an agreement with the accused through a mediator;
– information obtained during the mediative meeting cannot be used as evidence;
5) Provisions for providing mediation assistance have been added to the Law "On Guaranteed State Legal Assistance";
6) Changes to the Law "On the Status of Judicial Executors and Enforcement Proceedings" introduce the recognition of notarized mediation agreements as enforceable documents;
7) Amendments to the Labor Code make mediation a mandatory pre-trial procedure for resolving labor disputes.
This law will come into effect on January 1, 2027.
