Citizen K. Asanov, who survived a fall from the 13th floor of a high-rise building, asks the courts to fairly consider his case.

In the city of Osh, there was an incident where a construction worker managed to survive after falling from the 13th floor of an unfinished building. Kulchoro Asanov spoke about this at a press conference held on December 22 at AKIpress-Osh.

According to Asanov, the incident occurred on October 26, 2023, on Apsamat Masaliev Avenue in a building that is under construction. The worker fell from the 13th floor to the minus first floor and, fortunately, survived. He is currently awaiting a court decision on his case.

Asanov shared that after the incident, he had to spend a year and a half in bed. Representatives of the construction company visited him only once, after which communication with them was cut off. “On that day, October 26, 2023, I came to work, changed clothes, and while taking the elevator to the 16th floor, the elevator cable snapped at the 13th floor level. I fell to the minus first floor and lost consciousness. The ambulance could not reach me, and rescuers arrived to extract me. The elevator was installed illegally, and they did not want to take me to the state hospital, so I was taken to a private clinic, where they could not provide the necessary assistance. As a result, I was transferred to the regional hospital in Osh, where I underwent several surgeries: the first due to bowel prolapse, and then on my spine. After three surgeries, I was in a lot of pain, and three months later I was discharged, but there were no improvements,” he recounted.

After that, Asanov sought medical help again, where he underwent a fourth surgery. During the treatment, he ran out of funds and turned to the construction company, which managed to finance the installation of a stent in his spine costing 132,000 soms. In total, he spent six months in the hospital. Upon returning home, representatives of the construction company brought him food and promised assistance, but after he signed a statement of no claims, communication with them ceased. His case is currently being considered in court, and Asanov is calling on the judicial authorities for a fair resolution.

Kulchoro Asanov's lawyer, Jakshylyk Aripov, noted that the incident on October 26 occurred due to the snapping of the elevator cable, which was used without the necessary certifications. “Despite the presence of signs of a crime, law enforcement agencies refused to initiate a criminal case, citing the absence of a crime composition. We believe that there is a crime composition in this situation according to Article 272 of the Criminal Code,” he added.

Aripov also emphasized the lack of state control during construction work, particularly the use of a homemade elevator without certification. According to him, under construction legislation, the elevator should have been certified.

Furthermore, the lawyer pointed out serious violations of the Labor Code, emphasizing that a person who became a first-group disabled individual as a result of the accident has the right to compensation for seven years of lost earnings. The amount of compensation may be reduced depending on the degree of fault of the victim. These issues will be resolved in court, where claims for compensation for moral damage and reimbursement of medical expenses are also being considered.
