Fictitious Lessons and Real Money: The Supreme Court Has Made a Ruling in the Case of the School Director

The Supreme Court of the Kyrgyz Republic rejected the cassation appeal filed by the defense attorney of the former director of the school in the Suzak district of the Jalal-Abad region, N. I., on November 3, 2025. The court upheld the decisions of the previous instances.


The investigation established that N. I. (name changed to Nazgul), serving as the director since October 2022, formalized the academic load for the 2022–2024 academic years without the necessary orders and did not actually conduct classes. False information was entered into official documents, such as attendance sheets and journals, which served as the basis for her salary calculations.

As a result of these actions, the state incurred damages amounting to 142,941 soms, which Nazgul paid into the account of the Jalal-Abad regional prosecutor's office, and the amount was directed to the state treasury.

On February 7, 2025, the Suzak District Court found Nazgul guilty under part 2 of Article 337 of the Criminal Code of the Kyrgyz Republic, concerning abuse of office. She was sentenced to 3 years and 6 months of imprisonment in a general regime correctional facility and was deprived of the right to hold managerial positions in the education sector for 3 years.

On May 26, 2025, the appellate instance, reviewing the case, changed the procedure for serving the sentence and released the convicted from actual imprisonment based on the amnesty law but restricted her right to hold managerial positions in the education sector for 2 years.

The Supreme Court, having studied the cassation appeal of the attorney, concluded that the guilt of the convicted was proven and that there were no procedural violations, and also recognized the judicial acts as lawful and justified. In this regard, the cassation appeal was left unsatisfied.

Details

The court proceedings established that since October 5, 2022, Nazgul, working as the director of Secondary School No. 1 named after M.A. in the Suzak district, violated the approved tariff. In the 2022–2023 academic year, without an order, she divided classes into groups for "Russian language," formalizing 8 hours of academic load for herself while not conducting classes and instructing other teachers to fill out journals in her name, which led to her receiving a salary based on false information.

Thus, she illegally received a salary amounting to 111,350 soms and 97 tyiyn, which caused significant material damage to the state.

Continuing her illegal activities during the 2023–2024 academic year, from October to December, without the appropriate orders, she formalized 9 hours for the subjects "Technology" and "Russian language" in several classes, not conducting classes and entering false data into official documents, which also led to her illegal salary receipt.

As a result, she illegally received 31,590 soms, further exacerbating the material damage to the state.

The attorney for the accused requested in the cassation appeal to overturn the decisions of the first and appellate courts and acquit her.
