The investigation established that on March 14, 2025, a resident of the Aravan district of the Osh region, known as J. A. (name changed to Jaloliddin), during a conflict on Osh-3000 street, while driving his "DAEWOO Tico," fired several shots from a gas-traumatic pistol towards the victim's vehicle. As a result, the glass was shattered, and Jaloliddin left the scene. A minor daughter was in the victim's car, and the damage was estimated at 2000 soms.
The Aravan District Court on June 3, 2025, and the Judicial Panel of the Osh Regional Court on July 23, 2025, found Jaloliddin guilty but limited the punishment to a fine of 700 calculation indicators (which amounts to 70,000 soms). The victim filed a cassation appeal, demanding a stricter punishment, including actual imprisonment.
Jaloliddin is a citizen of Kyrgyzstan, unmarried, with a secondary education, unemployed, and with no prior convictions.
During the consideration of the cassation, the Supreme Court noted that the lower courts did not fully take into account the social danger of Jaloliddin's actions and the seriousness of the crime. The court emphasized that the shots were fired in the presence of a minor, which led to damage to the car's body and windshield, as well as caused moral suffering to the victim and his daughter.
When imposing a sentence, the court must consider the proportionality between the level of guilt and the severity of the harm caused. The Supreme Court concluded that the fine does not meet the goals of punishment and the principle of justice.
Taking into account all the aforementioned factors, the judicial panel decided that Jaloliddin should be sentenced according to paragraph 3 of part 2 of Article 280 of the Criminal Code of the Kyrgyz Republic (Hooliganism using firearms or gas-traumatic weapons, knives, and other objects intended to cause harm to health) — in the form of imprisonment for a term of 3 years.
