According to the draft, the document will be available in the state and official languages. After its adoption, it will be submitted to the Ministry of Justice for registration in the State Register of Regulatory Legal Acts and published in the newspaper "Erkin Too." It is expected to come into force seven days after its official publication.
Main Regulatory Elements
According to the justification, the purpose of developing APKR-6 (Part IV) is to create norms that will define the process of regulation and application of drones in civil aviation.The proposed rules will apply to UAV owners operating flights in the airspace and territory of Kyrgyzstan, as well as foreign citizens who have temporarily imported drones.
Among the main norms proposed in the document, the following can be highlighted:
- accounting and registration of UAVs (including the replacement of certificates, marking, and deregistration);
- certification of UAV operators (requirements for issuance, validity, health conditions, and substance use restrictions, rights of certified operators);
- certification of operators (preparation of applications, documentation assessment, inspections, and ongoing monitoring);
- organization of flights and responsibilities of operators, including the preparation of necessary documents for aviation operations;
- conditions for providing services by UAV owners, including minimum altitudes, restricted zones, and drop restrictions;
- rules for the use of Kyrgyzstan's airspace for UAVs;
- classification of UAVs based on accounting requirements and certification acquisition.
The authors of the project assure that the adoption of this order will not require changes to other regulatory acts, will not incur additional costs from the national budget, and, in their opinion, will not lead to negative social, economic, or legal consequences.
