The draft aims to standardize requirements for all categories of military personnel, as well as for other military formations and government agencies where military service is provided. These changes are in fulfillment of the instructions from the President's Administration given on March 16 and April 4, 2024.
Internal Service Statute
The document establishes the procedure for the transfer of orders and honorary titles between military units, which will help preserve combat traditions. It also defines the rules for the repair and replacement of battle flags if they do not meet modern standards.
New rules for military personnel regarding the performance of the National Anthem both in formation and in premises have been clarified, as well as the circumstances under which wearing a beard is permitted.
A new chapter dedicated to the safety of military service has been included, describing measures to prevent deaths, injuries, and illnesses among military personnel, as well as the responsibilities of commanders to ensure safety.
An appendix has been added with the ritual for raising and lowering the National Flag, as well as rules for its storage and use during military ceremonies.
Additionally, it is planned to revise the text of the statute in the state language adopted in 1998 to ensure it meets new requirements and takes into account the military history of the Kyrgyz people.
Garrison and Guard Service Statute
The draft excludes the position of the head of the garrison financial service, as it cannot manage the funds of different government agencies.
The actions of the patrol commander regarding military personnel of higher ranks in cases of disciplinary violations have been clarified.
Guards will receive resources to detect and counter unmanned aerial vehicles (UAVs). Due to the increase in population and traffic congestion, the response time for guards to reach their place of duty has been extended by one hour.
In light of the growing number of aircraft, a guard service will be introduced to protect airplanes and facilities at airfields.
Changes have been made to the ritual of unveiling monuments, which now takes into account national traditions and religious beliefs. The list of individuals designated for an honor escort during burial has been updated to include military personnel who died during training and participants in wars. The orchestra's music has been excluded from the funeral ritual.
Disciplinary Statute
In accordance with the new amendments, the term "military and state secret" has been replaced with "state secrets," which aligns with the law "On the Protection of State Secrets."
The rules for awarding military personnel with departmental awards and military insignia have been updated. It is also stipulated that military personnel must provide written explanations for disciplinary offenses, which is necessary for possible appeals.
Clear deadlines have been established for filing lawsuits regarding the contestation of dismissal orders and other decisions in the field of military service. The provision for placing military personnel in a guardhouse while in a state of intoxication has been excluded, as imprisonment is only possible by court decision.
The timelines for considering proposals and complaints from military personnel have been updated in accordance with the law "On the Procedure for Considering Citizens' Appeals."
The Ministry of Defense is confident that the implementation of this draft law will positively impact the alignment of military service with current legislation and help develop a unified understanding of the norms of the statutes.
