The Ministry of Natural Resources, Ecology, and Technical Supervision has presented a draft resolution of the Cabinet of Ministers, which includes the procedure for interaction between state authorities and local self-government bodies on issues of biological safety, as well as requirements for the physical protection of potentially dangerous biological objects.

This document was developed in accordance with Articles 7 and 11 of the Law of the Kyrgyz Republic "On Biological Safety." Its main goal is to eliminate shortcomings in legal regulation and to implement a comprehensive approach to preventing biological threats and risks.

The explanatory note emphasizes that under conditions of globalization, climate change, migration, and trade in livestock products, the likelihood of importing new infections and the spread of animal diseases threatening human health increases, as well as the emergence of biotechnologies dangerous to biodiversity and bioterrorism events.

The draft creates a foundation for effective interaction between agencies, establishing clear rules regarding who, to whom, and within what timeframes should provide information or perform certain actions. It includes various state bodies, such as the ministries of health, veterinary medicine, agriculture, as well as customs and border services.

As part of the project, the concept of a Unified Biological Data Platform (UBDP) is introduced, which will ensure the transition from regular activities to emergency mode. This will create a digital ecosystem for cooperation between agencies, allowing for more effective distribution of powers and responsibilities, as well as rapid information exchange in the event of biological threats.

Procedure for Interaction of State Authorities and Local Self-Government Bodies to Ensure Biological Safety Considering the Provisions of the Cartagena Protocol on Biosafety

I. General Provisions

This Procedure defines the mechanisms and procedures for interaction between state authorities and local authorities (hereinafter referred to as the Participants in Interaction) to implement the Law of the Kyrgyz Republic "On Biological Safety," as well as to prevent, detect, and eliminate biological threats, including work with genetically modified organisms (GMOs) and the transboundary movement of biological agents.

The main principles of interaction include:

- the obligation and timeliness of performing all established procedures;

- precaution and risk prevention;

- transparency of information and access to data;

- scientific justification of all decisions;

- mutual responsibility and control among state authorities;

- compliance with international standards.

Interaction will occur in two modes:

- Everyday Activity Mode – planned coordination and data exchange;

- Emergency Mode – actions in the event of specific threats or incidents.

The transition from the everyday mode to the emergency mode will be carried out in accordance with the Regulations on Actions in the Event of a Signal Event.

II. Participants in Interaction and Their Roles

The key participants in the interaction are:

- The Ministry of Economy and Commerce – determining priorities for economic development and implementing state policy;

- The Ministry of Water Resources and Agriculture – monitoring epizootic and phytosanitary risks;

- The Ministry of Natural Resources, Ecology, and Technical Supervision – protecting the environment and regulating natural resource use;

- The Ministry of Health – assessing biological risks and sanitary supervision;

- The Ministry of Emergency Situations – monitoring the state of the environment and managing in emergency situations;

- The Ministry of Digital Development – ensuring the operation of the Unified Biological Data Platform;

- The State Customs Service – controlling the transboundary movement of biological agents;

- Local authorities – providing current data and interacting with the population.

- Other bodies (including the Ministry of Internal Affairs and the National Security Committee) – participating according to their competence.

The Interagency Commission on Biological Safety under the Cabinet of Ministers of the Kyrgyz Republic will coordinate actions in emergency situations and carry out control activities in everyday operations.

III. Regulations for Interaction

Interaction in everyday activities will occur according to the Data Exchange Regulations, which define the volume of information, deadlines, and forms of data provision.

The activation of the Emergency Mode will be carried out according to the Regulations on Actions in the Event of a Signal Event, with the moment of activation being the registration of the event in the Unified Biological Data Platform.

Interaction in emergency situations will take place according to the Regulations for Interaction in Emergency Situations, which define the management scheme and the responsibilities of the operational headquarters.

Special procedures will be applied for monitoring and controlling the transboundary movement of biological agents.

Unified document forms mandatory for all state authorities will be used for documenting the interaction.

IV. Final Provisions

Violation of the interaction procedures established by this Procedure will entail liability in accordance with the legislation of the Kyrgyz Republic.

The Procedure will be reviewed at least once every five years, as well as when there are changes in the international obligations of the Kyrgyz Republic.

Interagency exercises will be conducted at least once a year to practice interaction.

Cooperation with international organizations will be carried out in accordance with international treaties through authorized bodies.

Appendix 1: Data Exchange Regulations in Everyday Activity Mode

- Data on laboratory monitoring, information on the epizootic situation, and results of monitoring of carriers.

- For each line: sender, recipient, deadline, data format.

Appendix 2: Regulations on Actions in the Event of a Signal Event

- Criteria for determining signal events and step-by-step action algorithm.

- Description of the form "Signal Event Card" with mandatory fields.

Appendix 3: Regulations for Interaction in Emergency Mode

- Organizational structure and responsibilities of the operational headquarters.

- Schedule of meetings and procedure for maintaining the "Emergency Event Log."
