Mowed clover in someone else's fields and threatened with a knife. A man was convicted in the Chuy region.

In the Chuy region, a man has been convicted for illegally mowing clover on rented plots. According to the ruling of the Supreme Court, he also threatened the land tenants.

Names have been changed.

Erkin was found guilty of self-will. As stated in the court documents, he knew that the land in the Sokuluk district belonged to other individuals, but in June 2023, threatening one of the tenants named Musa, he illegally harvested clover, making about a thousand bales, which he then took.

After that, he mowed clover again, collecting another 400 bales, which he sold, thereby causing Musa damage amounting to 560,000 soms.

When Erkin threatened and mowed clover again, Musa reported to the police, which prevented Erkin from taking the mowed clover.

Furthermore, threatening with a knife, Erkin intentionally cut the strings on 1,080 bales of pressed hay belonging to Musa, causing a loss of 47,000 soms.

Additionally, knowing that the plot of land belonged to Alan, Erkin unlawfully harvested clover in the same month, making 220 bales while threatening physical harm. Later, he mowed clover again, collecting another 300 bales and, threatening with violence, took them, causing damage of 208,000 soms.

When Erkin came to the field again with a knife, he cut the strings on 220 bales belonging to Alan, causing him damage of 11,500 soms.

The Sokuluk District Court found Erkin guilty on five counts under part 2 of Article 214 "Self-will with the use of violence or with the threat of its use" of the Criminal Code of the Kyrgyz Republic. The court sentenced him to five years of imprisonment in a general regime colony, but with the application of probation supervision for three years.
The Judicial Panel on Criminal Cases and Administrative Offenses of the Chuy Regional Court upheld the verdict.

In the cassation appeal, the convicted man's lawyer requests the cancellation of the decisions of the two instances and the acquittal of his client, claiming that the charges were not substantiated during the trial, and the defense arguments were not adequately assessed. He also noted that there were no facts of violence or threats from Erkin, and no damage was caused to the land plots.

The appeal also states that the victim Alan claimed he had long rented his land to the LLC "Ch.", where the alfalfa seeds were sown by the previous tenant. According to him, there were no conflicts with Erkin, and it is unclear under what conditions he used this land since representatives of LLC "Ch." were not summoned to court.

After discussing all the arguments of the cassation appeal, hearing the opinions of the parties, and reviewing the case materials, the Judicial Panel of the Supreme Court dismissed the lawyer's cassation appeal and confirmed the verdicts of the lower courts.
