According to the local administration, this building was erected on a land plot that previously belonged to school No. 6 named after Makarenko, located on Masaliev Street. In this regard, a lawsuit was filed in the Administrative Court of the Osh region for the return of the land to municipal ownership for its intended use.
The case reached the Supreme Court, which on December 23, 2025, annulled the decisions of the Osh city hall made in 2008 and 2012. According to information, several land plots belonging to school No. 6 named after Makarenko were transferred into private hands in the specified years, and various commercial facilities are now located on these lands. The land use control service appealed to the court to declare the city hall's decisions invalid, which was granted by the Supreme Court.
According to municipal data, of the original 2 hectares and 52 hundredths of land belonging to the school, 1,818 square meters were transferred to private individuals as a result of the aforementioned city hall decisions and were used for commercial purposes.
It is planned that starting in 2026, work will begin on demolishing illegal constructions around the school and restoring the land plot to its original state for further intended use.

The Osh City Court on December 13, 2024, recognized the developer as obligated to demolish the illegally constructed facility at their own expense and return the land plot to its original state. The area of this plot is 1,074.25 square meters.
As reported by the city hall, in 2011, the municipal property management of Osh provided a plot of 528 square meters near the Makarenko school for three years for landscaping and greening; however, a capital structure was built on this site.

According to information from local authorities, in 2008 and 2012, several plots belonging to the A. Makarenko gymnasium school were transferred into private ownership by decisions of the city hall. However, under current legislation, lands related to social facilities are not subject to privatization. In this regard, the interregional management of the Land and Water Supervision Service appealed to the Administrative Court of the Osh region to recognize these resolutions as invalid, which was done.
A similar situation is observed with the plots belonging to the Gorky school, where lands were also transferred to private owners by decisions of the city hall made in 2000-2001.
Local residents report that private owners are using lands belonging to schools for commercial purposes. Trade pavilions, restaurants, and other establishments have been built on the adjacent plots to educational institutions.
According to the press service of the Osh Regional Court, the case concerning the plots of the Gorky school is under consideration in the Administrative Court of the Osh region, while the issue regarding the A. Makarenko gymnasium school is being reviewed by the Supreme Court.
In December 2024, Turmush reported that a commercial structure of the "Kapital Bank" was previously built on the territory of school No. 6 named after Makarenko. The court ordered the owner of this building to demolish it and restore the original appearance of the area.
According to reports from September 2023, it became known that lands of 31 schools in the city of Osh were sold, on which commercial properties and restaurants were built.
