According to the Ministry of Defense, the main goal of these amendments is to unify the rights and responsibilities of military personnel of various categories, as well as to implement the directives of the president given on March 16 and April 4, 2024.
Internal Service Statute
In the updated Internal Service Statute, in addition to technical changes and the use of modern military terminology in the state language, it is proposed to:- establish the procedure for transferring orders and honorary titles to other units under the condition of legal succession;
- define the procedure for making decisions on the repair or replacement of the Battle Banner, as well as specify that outdated banners must be handed over to the archive or museum;
- enforce a provision whereby commanders and military personnel who lose the Battle Banner are held accountable, and the military unit may be disbanded;
- establish the procedure for handing over the Battle Banner and relics to the archive upon disbandment of the unit.
- the definition of military service safety as a system of conditions that protect personnel, the local population, and the environment from hazardous factors;
- the responsibility of commanders for identifying and preventing hazardous factors, as well as for organizing the elimination of emergencies and investigating incidents resulting in death or injury;
- the duties of commanders and military personnel to comply with safety requirements;
- measures for environmental protection and rational natural resource use in units are described.
Actions of military personnel during the performance of the State Anthem are also clarified, including placing a hand on the chest, and the text of the Statute in the Kyrgyz language is brought in line with current military terminology.
Garrison and Guard Service Statute
Changes also pertain to the Garrison and Guard Service Statute:In particular, it is proposed to:
- exclude the provision regarding the head of the financial service of the garrison;
- clarify the actions of the patrol commander in cases of disciplinary violations by military personnel;
- allow the equipping of guards with means for detecting and countering UAVs;
- increase the time for the movement of the guard to the duty station from 1 to 2 hours.
Additionally:
- in paragraph 326, the ritual of unveiling monuments is clarified, taking into account national characteristics;
- in paragraph 329, the category of individuals for whom an honor escort is appointed for funerals is defined;
- the provision regarding the playing of music by the orchestra at the conclusion of funerals is excluded from paragraph 343.
Disciplinary Statute
Changes have been made to the Disciplinary Statute of the Armed Forces concerning both the protection of state secrets and the procedures for holding individuals accountable:- paragraph 3 clarifies the duty of military personnel to safeguard state secrets;
- paragraph 46 describes the procedure for awarding departmental medals;
- paragraph 91 introduces the requirement for providing a written explanation prior to the imposition of disciplinary sanctions;
- paragraph 93 excludes the provision regarding the detention of military personnel in a state of alcohol intoxication;
- the procedure for executing sanctions during the filing of complaints is clarified;
- paragraph 124 is aligned with legislation regarding the consideration of citizens' appeals.
The document notes that the changes will not require additional expenditures from the republican budget and will not lead to negative consequences.
