Homeless Man Broke into Someone Else's Car and Set It on Fire to Keep Warm. He Was Sentenced.

In Bishkek, a homeless man was sentenced to 2.5 years in a penal colony for setting a car on fire. Information about the verdict was published on the "Digital Justice" portal.

Maxim found himself at the center of a criminal case related to the damage of someone else's property. It was reported that the homeless man, upon discovering a car belonging to Nazar, illegally entered the vehicle. In an attempt to warm himself, he set some paper on fire, which led to significant smoke. After that, Maxim left the car, fleeing the scene. As a result of his actions, the victim suffered damages amounting to 550,000 soms.

During the pre-trial investigation, Maxim's actions were classified under part 2 of article 216 of the Criminal Code of the Kyrgyz Republic, which pertains to the destruction or damage of someone else's property causing significant harm.

Disagreeing with the court's decision, Maxim filed an appeal, claiming that he did not set the car on fire and therefore did not cause any damage. He referred to physical evidence—a CD on which it is recorded that another person left the scene on a bicycle.

During the trial of the first instance, the accused partially admitted his guilt, noting that he was in a state of severe alcohol intoxication that day and did not remember all the circumstances of the incident.

The victim, Nazar, stated that his neighbor noticed someone opening his car but did not pay attention, believing it was the owner himself. One of the car doors was missing a lock. Nazar also accessed a video recording showing the accused arriving on a bicycle, opening the back door of the car, and getting inside.
