In its statement, the SCNS reminded that the review of criminal cases must be carried out in strict accordance with the established legal procedure. The agency pointed out that according to the Constitution of Kyrgyzstan, state power is based on a clear separation of powers among various state bodies.
The press service also noted that according to criminal procedural legislation, oversight of the legality of investigations conducted by investigative bodies (such as the SCNS and the Ministry of Internal Affairs) is assigned to the prosecutor's office, while the judiciary is responsible for administering justice.
As stated in Article 8 of the Criminal Procedure Code of the Kyrgyz Republic, the review of sentences and other court decisions is possible only in the manner established by the Criminal Procedure Code, and procedural decisions made by the investigator can only be reviewed by the supervisory authority.
Thus, the SCNS believes that the establishment of a commission to review criminal cases contradicts the fundamental principles of the Constitution, as the law prohibits interference in the investigative and judicial process.
In addition, the agency noted that in accordance with the directive of President Sadyr Japarov, a large-scale reform is being carried out within the SCNS, covering all aspects of its activities.
“The goal of the reform is to adapt the national security agencies to modern challenges, strengthen intelligence and counterintelligence operations, combat terrorism and extremism, as well as eradicate corruption and suppress organized crime, ensuring the economic and informational security of the country,” the press service clarified, adding that the SCNS operates within the law, respecting the rights and freedoms of citizens.
