According to South Korean law, there are only two types of punishment for this crime: the death penalty and life imprisonment. The prosecution insisted on the imposition of the death penalty; however, a moratorium on this measure has been in effect in the country since 1997.
In January of this year, Yoon Suk-yeol was already sentenced to five years in prison for obstructing an arrest related to a conflict between his security detail and law enforcement agencies in January 2025. In total, the former president is involved in eight legal proceedings, four of which concern the declaration of martial law.
Recently, the court also sentenced former Defense Minister Kim Yong-hyun to 30 years for his involvement in the coup.
It is worth recalling that on the night of December 4, 2024, Yoon Suk-yeol announced the declaration of martial law with the aim of "cleansing pro-North Korean forces and preserving the liberal constitutional order."
