Names have been changed.
On the defendants' bench were a Kyrgyzstani named Erkin and a citizen of Uzbekistan named Mustafa. According to the investigation materials, in April 2024, near a car wash in one of the capital's districts, Erkin handed over hashish to Mustafa for subsequent sale, receiving money for it in his electronic wallet. Mustafa, in turn, sold the drug to third parties.
Subsequently, in May and June of the same year, Erkin sold hashish to Mustafa again, which he also resold.
- The Oktyabrsky District Court found Erkin guilty of crimes under part 1 of Article 282 of the Criminal Code of the Kyrgyz Republic "Illegal production of narcotic drugs, psychotropic substances, and their analogs for the purpose of sale." He was sentenced to six years of imprisonment in a general regime correctional colony. However, he was released from serving his sentence under probation supervision for four years.
- Mustafa was also charged under part 1 of Article 282, and his sentence was set at six years of imprisonment in a general regime correctional colony. However, later the judicial panel of the Bishkek City Court changed his sentence, sending him to a strict regime correctional colony, and also ordered his deportation from the country. The other parts of the sentence remained unchanged.
The judicial panel of the Supreme Court noted that there was no evidence of prior collusion between the men for the joint sale of drugs; each acted independently, which justified the separate qualification of their actions.
Furthermore, the court noted that when determining the punishment, property confiscation was not applied, although such a measure is provided for by law.
As a result, the panel of the Supreme Court changed the previously issued sentence.
- Erkin was sentenced to six years of imprisonment with property confiscation, to be served in a general regime correctional colony.
- Mustafa received six years of imprisonment with property confiscation, to be served in a strict regime correctional colony.
