According to the new rules, the Council for Justice Affairs:
- creates a reserve of candidates for first-instance judges;
- organizes a competition for vacant positions of judges of the Constitutional and Supreme Courts, taking into account gender equality, so that no more than 70% of candidates are of the same gender;
- submits to the president a list of candidates for appointment to the Jogorku Kenesh for vacant positions of judges of the Constitutional and Supreme Courts;
- proposes candidates for appointment to first-instance judicial positions from the reserve, considering gender balance;
- establishes the regulations for the Council's work and other necessary documents;
- makes decisions on the suspension or termination of the powers of its members.
Candidates may submit documents to the Judicial Department in person, by mail, or via email.
The following documents must be attached to the application:
- a copy of the passport confirming citizenship and age;
- a certified copy of the diploma of higher legal education in the specialty "jurisprudence" or a master's degree;
- documents confirming work experience in the legal field;
- a medical certificate regarding health status, issued no later than 6 months before participating in the competition;
- a document confirming compliance with additional requirements established by law;
- a notarized copy of the certificate confirming knowledge of the state language at a level not lower than B1;
- a certificate of no criminal record for the candidate and their close relatives.
The list of diseases that prevent appointment to the position of judge will be established by the cabinet of ministers.For current judges, the documents must include:
- the personal file of the judge;
- information on the quantity and quality of cases reviewed during their work;
- data on awards and penalties.
Based on the selection results, candidates who score the highest points corresponding to the number of open positions will be chosen.
Candidates who receive an equal number of points will be accepted into the reserve by the Council's decision.
The results of the competition will be published within three working days.
A candidate may be excluded from the reserve in the following cases:
- at their own request;
- insufficient assessment of educational results;
- loss of citizenship;
- development of diseases that hinder work;
- recognition as incapacitated;
- death or declaration of them as deceased;
- committing a crime or actions that tarnish honor;
- refusal of the offered position.
