On the night of August 11 to 12, 2025, over 90 tons of fish died in this water body, causing significant financial damage to the lessee, estimated at more than 20 million soms.
After this, the entrepreneur submitted applications to the relevant authorities, including the Department of Fisheries and the veterinary service, but was forced to appeal to the prosecutor's office of the Chui region.
According to him, the prosecutor's office conducted an inspection during which water pollution was recorded, violation reports were drawn up, and a criminal case was initiated, the materials of which were transferred to the Main Internal Affairs Directorate of the Chui region for further investigation.
However, the businessman emphasizes that despite the initiation of the case, investigative actions are not being conducted properly: the applicant has not been interrogated for more than 20 days, and there has been no comprehensive investigation into the circumstances of the pollution and the death of the fish.
He also noted that he has not yet been recognized as a victim in the criminal case, although he is the applicant and the person who suffered damage.
His appeal emphasizes that according to part 3 of Article 40 of the Criminal Procedure Code of the Kyrgyz Republic, the investigator and the court are obliged to recognize a person as a victim from the moment of receiving a crime report.
The businessman expresses concern that the criminal case has been formally initiated, but the investigation is actually being delayed, and he, as the aggrieved party, is deprived of rights related to the process, such as access to case materials, filing petitions, and participating in investigative actions.
He hopes that the leadership of law enforcement agencies in the Chui region will ensure compliance with the norms of the CPC of the Kyrgyz Republic, promptly recognize him as a victim, and activate investigative actions, which will help protect the environmental rights of citizens.
Comment from the Internal Affairs Directorate
The police confirmed that on the night of August 11 to 12, 2025, there was a mass die-off of fish in the "Novoje" basin, resulting in the death of more than 90 tons of fish.A criminal case was initiated regarding this incident under Article 304 "Water Pollution" of the Criminal Code of the Kyrgyz Republic.
On November 7, 2025, the case was transferred to the investigative service of the Main Internal Affairs Directorate of the Chui region.
The police assured that the investigation will be conducted in accordance with the law, with adherence to objectivity and the inevitability of punishment.
The progress of the pre-trial proceedings will be under constant control of the agency.
