K.G. stated in her application that her son A.M. and daughter-in-law O.Z. divorced in 2014 after six years of marriage. The children stayed with their father, but they were raised by their grandmother.
Unfortunately, nine years ago, the children's father passed away, and in 2024, their mother also died. Based on the decision of the Naryn City Court, the grandmother became the official guardian of the minors.
Social workers informed the woman that a plot of agricultural land was registered in the name of her deceased daughter-in-law. Upon learning this, K.G. decided to register the land in the name of her grandchildren as legal heirs; however, the relatives of the daughter-in-law began to contest the right to the plot and create obstacles by refusing to provide the necessary documents.
Employees of the institute provided the woman with a consultation, explaining her rights and the procedure for appealing to the court.
According to Article 1142 of the Civil Code of the Kyrgyz Republic, the first-order heirs are children, spouse, and parents. In accordance with Article 1159 of the Civil Code, the inheritance is distributed by agreement among the successors, and in the absence of agreement — through the court.
After K.G. appealed to the Ombudsman Institute, she was assigned a free lawyer from the Legal Aid Service of the Ministry of Justice. Additionally, a request was sent to the regional branch of the State Agency for Land Resources, Cadastre, and Geodesy, which confirmed that the children's mother owned a plot of land measuring 58 acres in Naryn.
The representative of the Ombudsman helped the grandmother gather all the necessary documents, and she filed a lawsuit in court. After that, the parties contesting the plot agreed to a settlement.
As a result, the minors received a certificate of inheritance rights, which allowed them to register the land in their name.
