She emphasized that to date, the court can take mitigating circumstances into account if the perpetrator of the accident pays compensation and receives forgiveness from the victim's family.
The deputy also noted: "According to the proposed amendments, a perpetrator of a traffic accident that leads to death faces up to 12 years of imprisonment. Will this not lead to perpetrators evading payments to the victims?"
Deputy Minister of Internal Affairs Oktobyr Urmambetov clarified that if a fatal traffic accident occurred due to negligence and the perpetrator was sober, the possibility of reconciliation between the parties and the application of probation remains in effect.
“The main focus of the draft law is on cases where accidents result in the deaths of two or more people, as well as those that occur under the influence of alcohol. In such situations, probation is not applied. Everyone must be aware of their responsibility for their actions. As for compensation, it will be determined by the court and is mandatory for execution,” added the deputy minister.
