A pensioner, K. G., approached the representative of the akiykatchi in the Naryn region for help in protecting the inheritance rights of her grandchildren, who are 14 and 15 years old.
In her appeal, the woman stated that her son A. M. and daughter-in-law O. Zh. divorced in 2014 after six years of marriage. The children stayed with their father, and their grandmother became their guardian. Over the past nine years, they lost their father, and in 2024, their mother also passed away. The Naryn City Court officially confirmed the grandmother's status as guardian.
Social workers informed the pensioner that there was a registered agricultural land plot in the name of her deceased daughter-in-law. Upon learning this, the grandmother decided to register the plot in the name of her grandchildren as legal heirs.
However, the relatives of the daughter-in-law began to obstruct the registration of the land, refusing to provide the necessary documents.Staff from the institute assisted by explaining the pensioner's rights and the procedure for appealing to the court. They noted that according to Article 1142 of the Civil Code of the Kyrgyz Republic, the first order heirs are the children, spouse, and parents. Article 1159 of the Civil Code of the Kyrgyz Republic regulates that inheritance is distributed by agreement among the heirs, and in the absence of such an agreement, through the court.
After contacting the ombudsman's institute, the pensioner was assigned a free lawyer from the legal service of the Ministry of Justice.
A request was also sent to the regional branch of the State Agency for Land Resources, which confirmed the existence of a land plot of 58 hundredths in Naryn in the name of the mother of the teenagers.
“The authorized representative of the akiykatchi helped the grandmother gather the necessary documents, and after that, the pensioner went to court,” the statement said. “Only after this did the party contesting the land plot agree to a settlement.”
As a result, the minors received a certificate of inheritance rights and were able to register the land plot in their name.
